The Website is owned and operated by NANIA GLOBAL MARKETPLACE, a company registered in England and Wales (Company Number: 15544430), with its registered office at 64 Nile Street, London, United Kingdom, N1 7SR. NANIA GLOBAL MARKETPLACE trades as “SnapBrainy”.
Throughout these Terms, “we”, “us”, and “our” refer to NANIA GLOBAL MARKETPLACE trading as SnapBrainy.
BY ACCESSING THIS WEBSITE AND/OR COMPLETING A PURCHASE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND UNCONDITIONALLY AGREE TO BE BOUND BY THESE TERMS, INCLUDING OUR REFUND POLICY (SECTION 5) AND OUR Privacy Notice. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THIS WEBSITE OR PURCHASE OUR PRODUCTS.
2. User Accounts
To purchase Products from our Website, you must provide accurate and complete personal and payment information. Upon completing your first purchase, an account will be automatically created for you to facilitate future purchases and access to your purchased content. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3. Intellectual Property Rights
All content on this Website and all digital Products, including text, graphics, logos, images, audio clips, and software, are the property of NANIA GLOBAL MARKETPLACE or its content suppliers and are protected by United Kingdom and international copyright laws.
Upon purchase of a digital Product, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Product for your personal, non-commercial use only. You are strictly prohibited from sharing, reselling, reproducing, distributing, or otherwise exploiting our Products for any commercial purpose. This license does not constitute a sale or transfer of ownership.
4. Purchases and Payments
We utilize secure third-party payment processors, including Stripe and PayPal, to handle all transactions. We do not store your full credit card information on our servers.
The currency displayed on the Website may be adjusted based on your geographical location. The final transaction price and currency will be clearly stated at the final checkout stage before you complete your payment. You agree to provide a valid payment method and authorize us to charge it for the total amount of your order.
5. Refund Policy
This policy is a binding part of our Conditions of Use. It is designed to be transparent and compliant with UK consumer law, while clearly defining the terms for our global customers, particularly in the United States.
5.1. Digital Products (eBooks & Audiobooks)
- FINAL SALE & NO REFUNDS: Due to the intangible, irrevocable nature of digital content, which is delivered instantly and cannot be returned, ALL SALES OF DIGITAL PRODUCTS ARE FINAL AND NON-REFUNDABLE ONCE THE PRODUCT HAS BEEN DOWNLOADED OR ACCESSED. By completing your purchase, you explicitly agree to this condition.
- EXPLICIT WAIVER OF CANCELLATION RIGHTS (FOR UK/EU CUSTOMERS): Under the UK Consumer Contracts Regulations 2013, consumers typically have a 14-day “cooling-off” period to cancel a purchase. However, this right does not apply to digital content if the consumer consents to immediate supply and acknowledges that their right to cancel will be lost. BY PURCHASING AND INITIATING THE DOWNLOAD/ACCESS OF A DIGITAL PRODUCT FROM OUR WEBSITE, YOU PROVIDE YOUR EXPRESS CONSENT TO THE IMMEDIATE SUPPLY OF THE CONTENT AND YOU ACKNOWLEDGE AND AGREE THAT YOU FORFEIT YOUR STATUTORY 14-DAY RIGHT OF CANCELLATION.
- EXCEPTION FOR DEFECTIVE OR MISDESCRIBED PRODUCTS: Your right to a remedy is limited to the following circumstances:
- The digital file is technically defective (e.g., corrupted, incomplete, non-functional).
- The product is significantly different from its description on our Website.
You must report any such issue to us at [email protected] within 14 days of the purchase date, providing your order number and clear evidence of the defect. We reserve the right to first attempt to resolve the issue by providing a replacement file or a new download link. If we are unable to provide a functional replacement, a refund will be considered.
- CHARGEBACKS: You agree that this no-refund policy is clear and binding. Initiating a chargeback with your bank, Stripe, or PayPal for a reason other than a verified defective product (as defined above) or a proven unauthorized transaction is a violation of these Terms. We will actively dispute any such chargebacks by providing the payment processor with proof of these Conditions of Use, your IP address at the time of purchase, your access/download logs, and proof of your acceptance of these terms at checkout.
5.2. Physical Products (Merchandise)
- Right to Cancel: In line with the UK Consumer Contracts Regulations 2013, you have the right to cancel your contract for physical goods within 14 days without giving any reason. The cancellation period will expire 14 days from the day on which you acquire physical possession of the goods.
- Cancellation Process: To exercise the right to cancel, you must inform us of your decision by a clear statement sent to [email protected] before the cancellation period has expired. You must then return the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation.
- Return Shipping: You will be responsible for paying the direct cost of returning the goods. Return shipping costs are non-refundable.
- Condition of Returned Goods: You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. We reserve the right to make a deduction from the reimbursement for this loss in value.
- Refunds: If you cancel your contract, we will reimburse to you all payments received from you for the goods, including the costs of initial standard delivery. We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any goods supplied. The reimbursement will be made using the same means of payment as you used for the initial transaction.
- Damaged or Incorrect Items: If you receive a damaged, defective, or incorrect item, you must contact us at [email protected] within 48 hours of delivery, including photographic evidence. We will provide instructions for a return, replacement, or refund, and we will cover associated shipping costs in these specific cases.
6. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
7. Limitation of Liability
To the fullest extent permitted by law, NANIA GLOBAL MARKETPLACE shall not be liable for any indirect, incidental, or consequential damages resulting from the use of, or the inability to use, our Website or Products.
8. Changes to These Terms
We reserve the right to modify these Terms at any time. The “Last Updated” date at the top of this page will be revised accordingly. Your continued use of the Website after any changes constitutes your acceptance of the new Terms.
